Marriage-Based Green Card Package
Congratulations! You are interested in obtaining a green card for your spouse. If you have been married for less than 2-years, a successful petition will result in a 2-year green card. If you have been married for more than two years, a ten-year green card will be issued to your spouse upon successful completion of the process.
Among other requirements, to qualify for a marriage-based green card, your spouse should not have a criminal history, and the U.S. Sponsor will need to provide an Affidavit of Support which is the citizen's financial guarantee that the fiancé will not become a public charge.
If your spouse is currently in the United States but entered with a visa originally, he or she may be eligible for Adjustment of Status (remaining in the U.S. and interviewing at a local USCIS field office). If your spouse entered the U.S. undocumented, he or she will need to return to their home country for their interview. A 601-A waiver of inadmissibility will be required before leaving the country.
In the event that your spouse is in the U.S. on a B1/B2 tourist visa, it is important that you NOT file for a green card. It is not permissible to enter the country on a tourist visa with the intent to marry a citizen and apply for a green card. Please call us for a consultation if that is your situation.
